Privacy Policy

TERMS OF SERVICE

Effective date: January 3, 2026
These Terms of Service (the “Terms”) govern access to and use of www.buildmyrebusiness.com, related websites, online learning services, classroom offerings, course materials, and other services provided by Vandiver-Morgan, Inc. d/b/a The Real Estate Business School (“TREBS,” “we,” “us,” or “our”). By creating an account, enrolling in a course, making a purchase, or using our services, you agree to these Terms and our Privacy Policy. If you are enrolling through a high school, school district, employer, or other sponsoring organization, additional written terms may apply. If those written terms conflict with these Terms, the written agreement controls for that sponsored enrollment.

1. Eligibility and Account Information

You must provide accurate, current, and complete information. You are responsible for keeping your login credentials confidential and for activity conducted through your account. Accounts and course access are personal and may not be shared, transferred, or resold.

A parent, legal guardian, school, or other authorized representative may enroll a minor when permitted by law and applicable school policy. Students must meet any age, identity, education, or
regulatory requirements applicable to the course or credential sought.

Educational Services and Regulatory Requirements

TREBS offers Texas real estate qualifying education, Sales Apprentice Education (SAE), continuing education (CE), mentoring, and related educational products. Course availability and approval status may change. Students are responsible for selecting courses appropriate to their individual licensing or renewal requirements.

Where a course is regulated or approved by the Texas Real Estate Commission (“TREC”), the student must satisfy all applicable TREC requirements, including identity verification, attendance or seat-time requirements, course sequencing, examinations, waiting periods, and completion deadlines. TREBS may require additional information reasonably necessary to verify identity, administer a course, prevent fraud, or report credit.

No guarantee: Enrollment or course completion does not guarantee that a student will pass an examination, qualify for or receive a real estate license, obtain broker sponsorship or employment,
earn income, or achieve any particular business result.

3. Course Access and Technical Requirements

Unless a course description or written agreement states otherwise, online course access lasts for one year beginning on the date of purchase or enrollment. Access ends automatically when that period expires. Any extension or re-enrollment is subject to availability, current pricing, regulatory requirements, and TREBS approval.

Students are responsible for reliable internet access, a compatible device and browser, working email, and any additional technology identified in the course description. Temporary interruptions may occur for maintenance, security, upgrades, third-party outages, or circumstances beyond our reasonable control.

4. Prices, Payment Plans, and Authorization

Prices and available payment options are displayed at enrollment and may change prospectively. Applicable taxes, shipping, textbooks, or other separately identified charges may be added. When a student selects the two-payment plan, one-half of the purchase price is due at enrollment and the remaining one-half is due 30 days later. By selecting that plan and providing a payment method, the purchaser authorizes TREBS and its payment processor to charge the second installment to the payment method on file on or after the disclosed due date, unless the enrollment is canceled or adjusted under the Refund and Cancellation Policy.

If a payment is declined, reversed, overdue, or disputed, TREBS may suspend access, withhold completion documentation or regulatory credit to the extent permitted by law, and pursue the unpaid balance and reasonable collection costs. A purchaser should contact TREBS promptly to correct billing errors before initiating a chargeback.

5. Refund and Cancellation Policy

Each course purchased is treated separately for refund purposes, including courses purchased together as part of a package or program.

A student may request a refund for an individual course within 30 days of the original purchase date, provided the student has not completed that course. Once a course has been completed, the tuition paid or allocated to that course is nonrefundable. Completing one course in a package does not automatically prevent the student from receiving an otherwise eligible refund for another uncompleted course in that package.

Approved refunds are subject to a 5% processing fee. When courses are purchased as a discounted package, any refund will be calculated using the portion of the package price allocated by TREBS to the eligible course. For an eligible enrollment purchased through a payment plan, TREBS may
refund amounts already paid, less the processing fee and any nonrefundable amounts, and cancel the portion of a future installment attributable to the eligible course.

Refunds will not be issued because of:

A student’s unwillingness or failure to comply with TREC requirements;

A student’s inability to pass a course examination or final examination;or

A waiting period required between examination attempts.

Textbook purchases are nonrefundable.

If TREBS cancels a scheduled classroom course, affected students will be notified as soon as reasonably possible. The course will ordinarily be rescheduled. The student may attend the rescheduled course or receive a full refund for the canceled course without a processing fee. A course may be canceled because of instructor illness, the unavailability of a qualified replacement instructor, inclement weather, unsafe travel conditions, or similar circumstances beyond TREBS’s
reasonable control.

Refund requests must be submitted to info@trebs.us or made by calling 512-453-
0900. The request should identify the purchaser, student, course, purchase date, and reason for the request.

6. Course Completion, Examinations, and Credit

A course is “completed” when the student satisfies the completion standard established for that course, which may include required instructional time, assignments, identity checks, attendance, and a final examination. TREBS records control in determining course activity and completion, subject to correction of demonstrated error.

TREBS may decline to issue a certificate or report credit until required course elements are completed, identity and enrollment information are verified, and payment obligations are satisfied, to the extent permitted by law. Students are responsible for supplying the correct legal name, email address, TREC license number (if applicable), and other required information.

7. Student Conduct and Academic Integrity

Students may not:
Share accounts, passwords, examination questions, answer keys, or restricted course materials; Misrepresent identity, attendance, participation, course activity, or completion; Copy, record, scrape, download, reproduce, publish, sell, or distribute course content except as expressly permitted; Use unauthorized assistance or technology on an examination; Attempt to bypass security, timing, identity-verification, or course-completion controls; or Interfere with the website, platform, instructors, or other students.

TREBS may investigate suspected misconduct and may suspend or terminate access, invalidate completion, decline to report credit, or notify an appropriate school, sponsor, regulator, or law enforcement authority when reasonably necessary and legally permitted.

8. Intellectual Property

The website, videos, recordings, mentoring content, course text, slides, examinations, graphics, trademarks, and other materials are owned by or licensed to TREBS and are protected by intellectual-property laws. Subject to these Terms, TREBS grants the enrolled student a limited, personal, revocable, nonexclusive, nontransferable license to use course materials solely for the student’s education during the applicable access period.

No license is granted to reproduce, publicly display, create derivative works from, train an artificialintelligence system on, commercially exploit, or distribute the materials.

9. Communications

TREBS may send transactional emails concerning accounts, payments, course progress, schedules, regulatory matters, and service notices. TREBS may also send promotional emails to individuals who have consented or with whom we have an appropriate business relationship. Promotional recipients may unsubscribe through the link in the email or by contacting us.

TREBS does not use school-provided high-school student information to send promotional email unless the student or parent separately and lawfully requests marketing communications outside the school-sponsored program.

10. Third-Party Services and Links

Our services may depend on third parties, including Mindquilt, Keap, Authorize.net, hosting, email, analytics, and other operational providers. Third-party services may have their own terms and privacy practices. TREBS is not responsible for an external website or service that it does not control, but it remains responsible for its own obligations under applicable law and its written agreements.

11. Disclaimers

To the fullest extent permitted by law, the services and materials are provided “as is” and “as available.” TREBS does not warrant uninterrupted or error-free access or that all content will remain current after laws, regulations, forms, or industry practices change. Nothing in a course constitutes legal, tax, accounting, investment, or individualized professional advice.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply.

12. Limitation of Liability

To the fullest extent permitted by law, TREBS and its officers, employees, instructors, and agent will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, or goodwill arising from the services. To the fullest extent permitted by law, TREBS’s aggregate liability arising from a particular course or transaction will not exceed the amount paid to TREBS for that course or transaction during the 12 months
preceding the event giving rise to the claim.

This limitation does not exclude liability that cannot legally be limited or excluded.

13. Suspension and Termination

TREBS may suspend or terminate access for nonpayment, fraud, threats to security, academic misconduct, material violation of these Terms, or conduct that jeopardizes regulatory compliance. Provisions that by their nature should survive termination—including payment obligations, intellectual-property restrictions, disclaimers, liability limitations, and dispute terms—will survive.

14. Governing Law and Disputes

These Terms are governed by Texas law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any judicial proceeding arising from these Terms or the services must be brought in a state or federal court with jurisdiction in Travis County, Texas. Before filing suit, the parties agree to make a good-faith effort to resolve the dispute informally by written notice and discussion for at least 30 days.

15. Changes to These Terms

TREBS may update these Terms prospectively. The revised Terms will be posted with a new effective date. If a change materially affects an existing paid enrollment, TREBS will provide reasonable notice and will not retroactively reduce material rights promised for that enrollment unless required by law or agreed with the purchaser or sponsoring organization.

A separate K–12 Student Data Privacy Addendum follows this Policy and applies when TREBS receives or maintains student information in connection with services provided to a high school, school district, charter school, or other K–12 educational institution. If that Addendum or a written school agreement provides stronger protection, the stronger protection controls for the covered student information.

Information received from others

We may receive information from a school, district, parent, purchaser, employer, referral source, TREC, instructor, learning-platform provider, payment processor, or other service provider. We use school-provided student information only as described in the K–12 Student Data Privacy Addendum and the applicable school agreement.

2. How We Use Information

We may use personal information to:
Create and administer accounts and enrollments; Deliver courses, materials, examinations, mentoring, and student support; Authenticate users, document participation, prevent cheating or fraud, and protect systems; Process payments, installments, refunds, shipping, and accounting records; Issue certificates and report or verify course credit with TREC or an authorized sponsoring organization; Communicate about schedules, progress, deadlines, service changes, and support; Send promotional email where permitted, honor communication preferences, and measure campaign effectiveness; Operate, troubleshoot, secure, analyze, and improve our services; Comply with legal, regulatory, audit, contractual, and recordkeeping obligations; and Establish, exercise, or defend legal claims.

3. Cookies and Similar Technologies

We and our operational providers may use cookies, pixels, logs, and similar technologies for account login, security, preferences, course operation, analytics, and—on general-audience portions of the website—marketing measurement. Browser settings may allow users to block or delete cookies, but essential features may not function properly without them.

TREBS does not authorize advertising based on school-provided K–12 student information or activity within a school-sponsored course.

4. When We Disclose Information

We may disclose personal information to:

Service providers are permitted to process information only for appropriate business or educational purposes and should be subject to confidentiality, security, and use restrictions appropriate to their role. TREBS should verify those protections in its contracts before publishing this Policy.

5. Sale, Targeted Advertising, and Profiling

TREBS does not sell student names, contact information, or education records. TREBS does not sell personal data for money. If use of general-audience advertising or analytics technology is considered a “sale,” “sharing,” or “targeted advertising” under an applicable privacy law, an eligible consumer may submit an opt-out request using the contact information below.

TREBS does not use personal data to make decisions producing legal or similarly significant effects through solely automated profiling.

6. Promotional Email

We may send promotional email to prospective or current adult customers where permitted. A recipient may unsubscribe through the link in a promotional email or by contacting info@buildmyrebusiness.com. Unsubscribing from promotions does not stop necessary transactional, course, billing, security, or regulatory communications.

School-provided high-school student information is not placed on TREBS promotional-email lists unless the student or parent separately and lawfully requests such communication outside the school-sponsored program.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including course delivery, support, security, accounting, disputes, and compliance with TREC, tax, contractual, and other legal requirements. Retention periods vary by record type. K–12 student information is returned or deleted at the direction of the school or at the end of the authorized purpose, except to the extent retention is required by law, TREC rules, a valid school agreement, or necessary to document legitimately earned course credit. Any retained information remains protected and is not used for unrelated purposes.

8. Security

TREBS uses reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. These may include access controls, authentication, vendor management, secure transmission where appropriate, backups, staff practices, monitoring, and incident-response procedures. No system is completely secure, and we cannot guarantee absolute security.

9. Privacy Rights and Requests

Depending on residence and applicable law, a person may have rights to confirm whether we process personal data; access, correct, or delete personal data; obtain a portable copy; and opt out of certain sales, targeted advertising, or profiling. Some information may be exempt, and we may retain information when legally permitted or required.

To submit a request, email info@buildmyrebusiness.com, call 512-453-0900, or write to the address below. Please state that the request concerns privacy and identify the right being exercised.

We may request information reasonably necessary to verify identity and authority. An authorized agent may act where applicable law permits.

If we deny an eligible Texas consumer’s request, the consumer may appeal by replying to our decision or emailing info@buildmyrebusiness.com with “Privacy Appeal” in the subject line. We will respond as required by applicable law. A consumer may also contact the Texas Attorney General regarding unresolved concerns.

10. Children and K–12 Students

Our general website is not directed to children under 13, and we do not knowingly collect personal information online directly from a child under 13 without authorization permitted by law. When services are provided through a K–12 school, the school may authorize collection for a school purpose where legally permitted. TREBS will provide required notices and will obtain parental consent when the school is not legally authorized to provide consent.

Parents and eligible students should ordinarily direct requests concerning school-controlled education records to the student’s school. We will cooperate with the school as required by applicable law and agreement.

11. External Links

Our services may link to third-party websites that we do not control. Their privacy practices are governed by their own notices. Users should review those notices before providing information.

12. Changes to This Policy

We may update this Policy to reflect changes in law, technology, services, or practices. We will post the revised Policy with a new effective date and provide additional notice when required. Material changes affecting school-provided K–12 student information will be handled in accordance with the applicable school agreement and student-privacy law.

K–12 Student Data Privacy Addendum

For services provided to high schools, school districts, charter schools, and other K–12
educational institutions
This K–12 Student Data Privacy Addendum (“Addendum”) describes the commitments of VandiverMorgan, Inc. d/b/a The Real Estate Business School (“TREBS”) concerning personal information received, collected, maintained, or generated in connection with services provided for a K–12 school purpose (“Covered Student Information”). It is intended to support compliance with applicable student-privacy requirements, including the Family Educational Rights and Privacy Act (“FERPA”), the Children’s Online Privacy Protection Act (“COPPA”) when applicable, and Texas Education Code Chapter 32.

This Addendum supplements TREBS’s Privacy Policy and any agreement with the school or district (“School”). If a signed agreement provides stronger privacy or security protections, the stronger provisions control.

1. Covered Student Information

Covered Student Information may include student name, contact information, identifiers, school and class information, account credentials, course activity, attendance, progress, assignments, examination results, completion status, certificates, technical logs, and other information linked or
reasonably linkable to an individual student and collected for a school purpose. Covered Student Information does not include de-identified information that cannot reasonably be used to identify an individual student, provided TREBS does not attempt to re-identify it.

2. Limited Educational Use

TREBS will collect, use, and disclose Covered Student Information only to:
Provide, operate, support, secure, and improve the School-authorized educational service; Create and administer student accounts, courses, examinations, and certificates; Provide the School with authorized progress, completion, or compliance information; Satisfy TREC or other legal and regulatory requirements applicable to the authorized course; Prevent fraud, cheating, misuse, or threats to safety or system security; and Comply with a lawful School instruction, contract, or legal requirement.

TREBS will not condition participation on collection of personal information beyond what is reasonably necessary for the authorized school purpose.

3. Prohibited Uses

TREBS will not:
Sell or rent Covered Student Information; Use Covered Student Information for targeted advertising to a student, parent, or household; Use school-provided contact information to send unrelated promotional email; Create a student profile for a purpose unrelated to the School-authorized service; Use Covered Student Information to train a commercial artificial-intelligence model or for unrelated product development; Disclose Covered Student Information except as allowed by this Addendum, the School agreement, or law; or Retain Covered Student Information longer than needed for the authorized purpose or required recordkeeping.

4. FERPA Role and School Control

When the School discloses education records to TREBS under FERPA’s school-official exception, TREBS will perform an institutional service or function for which the School would otherwise use employees; remain under the School’s direct control with respect to use and maintenance of the records; use the information only for the purpose for which it was disclosed; and not redisclose personally identifiable information except as authorized by the School or permitted by law.

TREBS will reasonably assist the School in responding to a parent’s or eligible student’s lawful request to inspect, review, correct, or amend education records maintained by TREBS.

5. COPPA and Younger Students

TREBS’s real estate courses are ordinarily intended for high-school-age students and adults, not children under 13. If a School authorizes use by a child under 13, TREBS will provide the School with the information needed to give notice and authorize collection for the school purpose where permitted. TREBS will obtain verifiable parental consent when required and will not rely on School authorization for a commercial purpose.

6. Service Providers

TREBS may give a service provider access to Covered Student Information only when the access is reasonably necessary to provide an authorized educational or operational service. Before doing so, TREBS will require the provider, through appropriate written terms, to protect the information; use it only for the contracted purpose; refrain from prohibited advertising, sale, profiling, and redisclosure; address security incidents; and return or delete the information as appropriate.
Relevant providers may include Mindquilt for course delivery and other providers for hosting, security, communications, payment, support, or regulatory reporting. TREBS remains responsible for selecting and overseeing providers consistent with its legal and contractual obligations

7. Security Program

TREBS will maintain reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of Covered Student Information. The program will include, as appropriate: Role-based access limited to personnel with a legitimate educational or operational need; Authentication and password controls; Secure transmission and storage practices appropriate to the information; Reasonable logging, monitoring, malware protection, patching, backup, and recovery practices; Workforce confidentiality and privacy expectations; Service-provider diligence and contractual controls; and A documented process for responding to security incidents.

8. Security Incident Notice

TREBS will notify the School without unreasonable delay after confirming unauthorized acquisition, access, use, or disclosure of Covered Student Information that materially affects its confidentiality, integrity, or availability, subject to any more specific contractual or legal deadline. Notice will include available information reasonably necessary for the School to understand the incident, take protective action, and satisfy applicable notice obligations. TREBS will investigate, mitigate,
preserve relevant evidence, and cooperate with the School.

9. Access, Correction, and School Requests

Upon a verified request from the School, TREBS will reasonably assist with access to, correction of, export of, or deletion of Covered Student Information under TREBS’s control. Parents and students should generally submit education-record requests through the School so that the School can verify identity, authority, and applicable rights.

10. Retention, Return, and Deletion

At the School’s direction or when the School-authorized purpose ends, TREBS will return or securely delete Covered Student Information within a reasonable period, unless retention is required by law, TREC rules, or the School agreement. TREBS will document or certify deletion
when reasonably requested.

If TREBS must retain a limited record to establish course enrollment, completion, credit, payment, audit compliance, or a legal claim, TREBS will retain only what is reasonably necessary, protect it under this Addendum, restrict access, and not use it for advertising or unrelated purposes.

11. De-identified and Aggregated Information

TREBS may use de-identified or aggregated information to operate, secure, evaluate, or improve its educational services only if reasonable measures prevent identification of an individual student, TREBS publicly commits not to re-identify the information, and TREBS contractually prohibits recipients from attempting re-identification.

12. Changes and School Notice

TREBS will not materially reduce the privacy protections applicable to Covered Student Information through a unilateral online-policy change during an active School agreement. Material changes will be communicated to the School and handled as required by the agreement and applicable law.

13. School Contact and Cooperation

The School may direct privacy, security, or student-record questions to:
